  1. Acceptance of Terms

    By registering for or using myMadiDiary (the “Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use or access the Service.

  2. Eligibility

    You must be at least 16 years old to create an account. By using our Service, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and up-to-date.

  3. Account Registration & Security
    • Account Creation. To access certain features (e.g., exporting journals, syncing across devices), you must register for an account by providing a valid email address and creating a secure password.
    • Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use or security breach.
  4. Subscription Plans & Pricing
    • FREE Plan: Limited to basic features (e.g., journaling entries, simple planner templates, 500 MB storage).
    • STANDARD Plan: Includes additional storage (5 GB), advanced templates, recurring reminders, and basic collaboration tools for $4.99 per month (or $49.99 per year).
    • PREMIUM Plan: Unlimited storage, premium templates, team collaboration, priority support, and integration with external calendars for $9.99 per month (or $99.99 per year).

    Prices may vary based on region. All fees are payable in USD (or local currency equivalent) and exclusive of applicable taxes. If you reside within the European Union and do not provide a valid VAT number, VAT will be added to your subscription price in accordance with EU regulations.

  5. Billing & Payment
    • Payment Processing. We use Stripe (or a similar PCI-compliant payment processor) to handle transactions. By providing payment information, you authorize us to charge your chosen payment method for the applicable subscription fees.
    • Invoice & Receipts. Upon successful payment, an invoice will be emailed to you. You can also download invoices from the “Billing” section of your account settings at any time.
    • Taxes. You are responsible for all applicable taxes (e.g., VAT, sales tax, digital services tax). If you are subject to taxes in your jurisdiction, you may be required to remit those taxes separately.
  6. Free Trial

    New users may be eligible for a 14-day free trial of the STANDARD or PREMIUM plan. During the trial, you have full access to all features associated with that tier. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the then-current rate. You can cancel anytime before the trial expires to avoid charges.

  7. Subscription Changes & Renewal
    • Upgrades/Downgrades. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately (pro-rated credit for the unused portion of the existing plan may apply). Downgrades take effect at the next billing cycle.
    • Automatic Renewal. Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before renewal.
    • Price Changes. We may modify subscription fees at our discretion. If prices change, we will provide notice at least 30 days before applying new rates. Continuing your subscription after the modification date signifies your acceptance of the updated pricing.
  8. Cancellation & Termination
    • User-Initiated Cancellation. You can cancel your subscription at any time via the “Billing” section of your account. Upon cancellation, you retain access to your current plan until the end of the billing period; afterward, your account reverts to the FREE plan (with basic features only).
    • Account Termination. We reserve the right to suspend or terminate your account without notice if you:
      • Violate these Terms or any applicable laws.
      • Engage in fraudulent or abusive behavior.
      • Provide false or misleading information to us.

    Upon termination, access to all paid features is revoked. We may delete your data following our Data Retention policies, subject to any legal obligations to preserve certain information.

  9. User Conduct & Content
    • Your Content. You retain full ownership of all journal entries, planner data, and uploaded files. By uploading or storing data on myMadiDiary, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely to provide you the Service.
    • Prohibited Activities. You agree not to:
      • Upload content that is unlawful, harmful, or infringes third-party rights.
      • Attempt to reverse-engineer or tamper with our application.
      • Use bots, scrapers, or automated scripts to access myMadiDiary without permission.
      • Impersonate another person or misrepresent your affiliation.

    Violations may result in content removal, suspension, or termination of your account.

  10. Intellectual Property Rights
    • Our Rights. All trademarks, service marks, trade names, and logos (“myMadiDiary IP”) are owned by or licensed to myMadiDiary. Nothing in these Terms grants you any rights to use our IP outside the scope of providing or marketing our Service.
    • Your Rights. You retain ownership of your original content (journal entries, templates you create, etc.). We do not claim ownership over your personal writings or data.
  11. Disclaimers & Limitation of Liability
    • “AS IS” Basis. myMadiDiary and all associated content are provided on an “as is” and “as available” basis without warranties of any kind. We expressly disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
    • Limitation of Liability. To the fullest extent permitted by law, myMadiDiary’s total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amounts paid by you in subscription fees during the twelve (12) months preceding the claim. In no event shall myMadiDiary be liable for any indirect, incidental, consequential, special, or punitive damages.
  12. Indemnification

    You agree to defend, indemnify, and hold harmless myMadiDiary, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with: (a) Your access to or use of the Service; (b) Your content or User Content; (c) Your violation of these Terms; or (d) Your infringement of any third-party rights.

  13. Governing Law & Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of [State/Province, Country], without regard to conflict of laws principles.     • Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    • Force Majeure. myMadiDiary shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control (e.g., acts of God, network outages, or government actions).
